(ARISING FROM MOTION HEARING ON JANUARY 17, 2018)

WHEREAS on September 12, 2017, the Mutual Fund Dealers Association of Canada (“MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of By-law No. 1 in respect of a disciplinary proceeding commenced against Harold Magnus Backer (“Respondent”);

AND WHEREAS the Notice of Hearing was personally served on the Respondent on September 20, 2017;

AND WHEREAS the first appearance in this proceeding took place by teleconference before the Chair of a hearing panel of the Pacific Regional Council of the MFDA (“Hearing Panel”) on November 9, 2017 at 1:30 p.m. (Pacific) in accordance with s. 19.13(b) of MFDA By-law No. 1;

AND WHEREAS on January 17, 2018 the Respondent’s motion took place before the Hearing Panel to set a date for the hearing on the merits in Fall of 2018, which the Respondent amended at the motion to June 25-29, 2018;

IT IS HEREBY ORDERED THAT:

  1. Subject to any further order of the Hearing Panel, the hearing of this matter on its merits shall take place before the Hearing Panel in Vancouver, British Columbia, at a venue to be determined, commencing on June 25, 2018 at 10:00 am (Pacific) to June 29, 2018.
  1. The absolute deadline for the Respondent to file a Reply is February 2, 2018.
  1. In accordance with Rule 11 of the MFDA Rules of Procedure, the parties shall exchange witness lists and disclosure of the anticipated testimony of witnesses on or before May 25, 2018.
  1. In accordance with Rule 10 of the MFDA Rules of Procedure, the parties will exchange any documents that they intend to rely on at the hearing on the merits by May 25, 2018.
