Order

WHEREAS this motion, before a hearing panel of the Pacific Regional Council (the “Hearing Panel”) of the Mutual Fund Dealers Association of Canada (the “MFDA”) for leave to amend the Notice of Hearing and adjourn hearing dates by consent, was heard in writing on May 22, 2019 at Vancouver, British Columbia;

And Whereas pursuant to s. 19.13 of MFDA By-Law No. 1, one public representative of a Regional Council may be designated to act on behalf of a Hearing Panel for the purpose of hearing and determining any procedural matter or motion relating to the conduct of a disciplinary hearing under sections 20 and 24 including, without limitation, granting adjournments, setting dates for hearings, and making any other orders or directions that a Hearing Panel is authorized to make under the Corporation’s rules of procedure, except a final determination of a disciplinary proceeding;

AND WHEREAS on reading the submissions of counsel for Staff of the MFDA and being satisfied that the Respondent’s counsel has been served with this Notice of Motion by email and has confirmed consent to the relief sought;

IT IS HEREBY ORDERED THAT:

The relief requested is granted.

  1. By consent, granting leave to amend the Notice of Hearing in this proceeding; and
  2. By consent, leave to adjourn the June 24-27, 2019, hearing dates to August 12-14, 2019.
