Order

WHEREAS on March 25, 2019, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to section 24.4 of By-law No. 1 in respect of a disciplinary proceeding commenced against Kyle Norman Kidnie (the “Respondent”);

AND WHEREAS on May 16, 2019, the first appearance in this proceeding was held by teleconference before a Chair of a hearing panel of the Central Regional Council of the MFDA (the “Hearing Panel”), pursuant to section 19.13(b) of MFDA By-law No. 1;

AND WHEREAS at the first appearance, the Hearing Panel ordered among other things, that the hearing of this matter on its merits shall take place before the Hearing Panel in the hearing room located at 121 King Street West, Suite 1000, Toronto, Ontario on June 18, 2019 and June 19, 2019, commencing daily at 10:00 a.m. (Eastern);

AND WHEREAS on May 27, 2019, the Respondent and Staff of the MFDA (“Staff”) entered into a Settlement Agreement;

AND WHEREAS on May 27, 2019, the Respondent contacted Staff to request an adjournment of the hearing on the merits;

AND WHEREAS on May 28, 2019, Staff informed the Hearing Panel of the Respondent’s adjournment request, which was unopposed by Staff;

AND WHEREAS the Hearing Panel granted the adjournment and directed that a second appearance take place by teleconference on June 18, 2019, commencing at 10:00 a.m. (Eastern) in order to set a date for the settlement hearing;

AND WHEREAS Counsel for Staff and Counsel for the Respondent attended the second appearance by teleconference and made submissions to the Hearing Panel with respect to scheduling and other procedural matters;

IT IS HEREBY ORDERED THAT:

1. The settlement hearing will take place on September 27, 2019, commencing at 10:00 a.m. (Eastern), or as soon thereafter as the matter can be heard, in the hearing room at the offices of the MFDA, 121 King Street West, Suite 1000, Toronto, Ontario.
