Order

WHEREAS on January 18, 2016, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of MFDA Bylaw No. 1 in respect of a disciplinary proceeding commenced against Mervin Evans Visneskie (the “Respondent”);

AND WHEREAS the Respondent filed a Reply on March 31, 2016;

AND WHEREAS the first appearance took place on May 9, 2016 via teleconference before one public representative of a Regional Council acting on behalf of a Hearing Panel of the Central Regional Council of the MFDA (the “Hearing Panel”), pursuant to section 19.13(b) of MFDA Bylaw No. 1;

AND UPON hearing the submissions of counsel for the Respondent and counsel for Staff of the MFDA (“Staff”) at the first appearance with respect to various procedural matters including service of the Notice of Hearing on the Respondent; the filing of the Reply; proposed dates for the provision of disclosure and willsay statements; and proposed dates for the hearing on the merits;

IT IS HEREBY ORDERED THAT:

1. Staff shall provide disclosure to the Respondent by July 28, 2016, in accordance with Rule 10.1 of the MFDA Rules of Procedure;

2. The Respondent shall provide disclosure to Staff by August 25, 2016, in accordance with Rule 10.2 of the MFDA Rules of Procedure;

3. Staff shall provide a witness list and willsay statements to the Respondent by September 29, 2016, in accordance with Rule 11 of the MFDA Rules of Procedure;

4. The Respondent shall provide a witness list and willsay statements to Staff by October 27, 2016, in accordance with Rule 11 of the MFDA Rules of Procedure;

5. November 21, 2016 is scheduled as a “to be spoken to” teleconference appearance date before the Hearing Panel; and

6. The Hearing on the Merits shall proceed before the Hearing Panel in the MFDA hearing room located at 121 King Street West, Suite 1000, Toronto, Ontario on March 6-10, 2017 at 10:00 a.m. (Eastern) each day, or as soon thereafter as possible.
