Order
WHEREAS on December 14, 2018, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of By-law No. 1 (the “Notice of Hearing”) in respect of a disciplinary proceeding commenced against Blair Harcourt Addison (the “Respondent”) which shall take place before a hearing panel of the Central Regional Council (the “Hearing Panel”);
AND WHEREAS an affidavit of service sworn by Prianka Kalraiya on January 7, 2019 and filed by Staff of the MFDA (“Staff”) states that on December 21, 2018, Ms. Kalraiya served the Respondent with the Notice of Hearing by sending a true copy by registered and ordinary mail to the Respondent’s last known address as recorded in the MFDA’s records;
AND WHEREAS Staff identified a new home address for the Respondent following the service of the Notice of Hearing by registered and ordinary mail;
AND WHEREAS an affidavit of service sworn by Carlyle Murray on January 23, 2019 and filed by Staff states that on January 22, 2019, Mr. Murray personally served the Respondent with a true copy of the Notice of Hearing;
AND WHEREAS in accordance with s. 19.13 of MFDA By-Law No. 1, the first appearance in this hearing was held by teleconference before a public representative of the Central Regional Council of the MFDA on January 29, 2019;
AND WHEREAS counsel for Staff attended the first appearance by teleconference on January 29, 2019 to address scheduling and other procedural matters;
AND WHEREAS the Respondent was not in attendance;
AND WHEREAS counsel for Staff requested that the first appearance in this proceeding be adjourned so the Respondent could be provided the 30 days’ notice stipulated in Rule 7.1 of the MFDA Rules of Procedure from the date of personal service;
IT IS HEREBY ORDERED THAT:
- Service of the Notice of Hearing on the Respondent is validated pursuant to Rule 4.8 of the MFDA Rules of Procedure;
- The first appearance in this matter is adjourned to February 27, 2019 at 10:00 a.m. (Eastern), and will take place by teleconference before the Hearing Panel in the hearing room at the MFDA offices, 121 King Street West, Suite 1000, Toronto, Ontario; and
- The Respondent’s approval as to form and content of this Order is hereby dispensed with.
