Order

(ARISING FROM APPEARANCE ON DECEMBER 10, 2019)

WHEREAS on October 1, 2019, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of By-law No. 1 in respect of a disciplinary proceeding commenced against Rebecca Wai-Chiu Li (the “Respondent”);

AND WHEREAS on November 20, 2019, MFDA Staff posted the Notice of Hearing on the MFDA’s public website and issued a news release;

AND WHEREAS on December 10, 2019, the first appearance in this proceeding was held before one public representative of a Regional Council acting as Chair on behalf of a hearing panel of the Central Regional Council of the MFDA (the “Hearing Panel”), pursuant to s. 19.13 of MFDA By-Law No. 1;

AND WHEREAS at the first appearance on December 10, 2019, no one appeared on behalf of the Respondent;

AND WHEREAS Staff advised the Chair of the Hearing Panel that it had made unsuccessful attempts to personally serve the Respondent with the Notice of Hearing, and made submissions in respect of service of the Notice of Hearing on the Respondent by email and regular mail;

AND UPON reading the affidavit of Martha Reilly, sworn November 12, 2019, the affidavit of Thomas Perrotti, sworn November 12, 2019, and the affidavit of Terri Ash, sworn December 9, 2019, and on hearing the submissions of Staff;

IT IS HEREBY ORDERED THAT:

  1. Staff has served the Respondent with the Notice of Hearing in accordance with the provisions of Rules 4.2(1)(b), 4.2(1)(d), and 4.8(1) of the MFDA Rules of Procedure, by email and regular mail at the Respondent’s last known address, and by posting the Notice of Hearing and issuing a news release on the MFDA public website; and
  2. The hearing of this matter on its merits shall take place on March 25 and 26, 2020, commencing at 10:00 am (Eastern) each day, in the hearing room at the offices of the MFDA, 121 King Street West, Suite 1000, Toronto, Ontario.
