Order

WHEREAS on December 10, 2019, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Settlement Hearing pursuant to section 24.4 of By-law No. 1 in respect of Kenneth Daniel Foster (the “Respondent”);

AND WHEREAS the Notice of Settlement Hearing stated that the hearing of this matter shall take place at the Sheraton Hotel Newfoundland, 115 Cavendish Square, St. John’s, Newfoundland on January 23, 2020, commencing at 10:00 a.m. (Newfoundland), or as soon thereafter as the matter can be heard;

AND WHEREAS on January 23, 2020, an appearance in this proceeding was held by teleconference before a Hearing Panel of the Atlantic Regional Council of the MFDA (the “Hearing Panel”);

AND WHEREAS on January 23, 2020, during the procedural appearance Staff and Counsel for the Respondent jointly requested that the Hearing Panel adjourn the settlement hearing for the reason that a State of Emergency was declared for the City of St. John’s due to weather conditions;

AND WHEREAS Staff and Counsel for the Respondent made submissions to the Hearing Panel with respect to rescheduling the settlement hearing;

AND WHEREAS on January 23, 2020, the Hearing Panel granted the adjournment requested by the Parties.

IT IS HEREBY ORDERED THAT:

1. Subject to any further Order of the Hearing Panel, the settlement hearing in this matter shall take place before the Hearing Panel in the hearing room at the Sheraton Hotel Newfoundland, 115 Cavendish Square, St. John’s, Newfoundland on March 26, 2020 at 10:00 a.m. (Newfoundland), or as soon thereafter as the matter can be heard.
