Order

WHEREAS on January 22, 2020, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of By-law No. 1 in respect of a disciplinary proceeding commenced against Arman Pekel (the “Respondent”);

AND WHEREAS the Notice of Hearing was served on the Respondent’s counsel by email on January 31, 2020;

AND WHEREAS the Respondent served and filed a Reply to the Notice of Hearing on February 20, 2020;

AND WHEREAS on March 31, 2020 the first appearance in this proceeding was held by teleconference before one public representative of a Regional Council acting on behalf of a hearing panel of the Central Regional Council of the MFDA (the “Hearing Panel”), pursuant to s.19.13 of MFDA By-Law No. 1;

AND WHEREAS the Hearing Panel adjourned the first appearance to April 1, 2020;

AND WHEREAS on April 1, 2020 the first appearance was held by teleconference before the Hearing Panel, during which counsel for Staff of the MFDA and counsel for the Respondent made submissions to the Hearing Panel with respect to scheduling and other procedural matters.

IT IS HEREBY ORDERED THAT:

1. The Hearing on the Merits shall take place on October 5 – 6, 2020 at 10:00 a.m. (Eastern) each day, by electronic hearing or in the hearing room at the MFDA offices, 121 King Street West, Suite 1000, Toronto, Ontario; and
2. An additional appearance in this matter will take place by teleconference on June 2, 2020 at 10:00 am to determine procedural matters, including the venue for the Hearing on the Merits.
