Order

(ARISING FROM FIRST APPEARANCE ON JULY 9, 2020)

WHEREAS on June 5, 2020, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of By-law No. 1 in respect of a disciplinary proceeding commenced against Leszek Dziadecki (the “Respondent”);

AND WHEREAS on June 17, 2020 the Notice of Hearing was emailed to the Respondent;

AND WHEREAS the Respondent acknowledged receipt of the Notice of Hearing the same day;

AND WHEREAS the first appearance in this proceeding was held by videoconference on July 9, 2020 before one public representative of a Regional Council acting on behalf of the Central Regional Council of the MFDA (the “Hearing Panel”), pursuant to section 19.13(b) of MFDA By-law No.1;

AND WHEREAS the Respondent appeared in person without counsel;

AND WHEREAS Staff of the MFDA made a request, unopposed by the Respondent, for an order:

  1. that service of the Notice of Hearing on the Respondent by email on June 17, 2020 was effective; and
  2. abridging the 30 days’ notice period between service of Notice of Hearing and the first appearance required under Rule 7.1 of the MFDA Rules of Procedure to permit the Hearing Panel to proceed with the first appearance on July 9, 2020;

IT IS HEREBY ORDERED THAT:

  1. On June 17, 2020, the Notice of Hearing was effectively served on the Respondent by email pursuant to the discretion of the Hearing Panel in accordance with Rule 4.2.1(d) of the MFDA Rule of Procedure;
  2. The 30 days’ notice period required under Rule 7.1 of the MFDA Rules of Procedure is abridged pursuant to the discretion of the Hearing Panel in accordance with Rules 1.3, 1.5 and 2.2(1)(a) of the MFDA Rules of Procedure;
  3. A further appearance in this matter is scheduled by teleconference on September 24, 2020 at 10:00 a.m. (Eastern); and
  4. The hearing on the merits of this matter shall take place by videoconference on January 19, 2021 at 10:00 a.m. (Eastern), or as soon thereafter as the matter can be held.
