Order

(ARISING FROM THE FIRST APPEARANCE ON JANUARY 25, 2022)

WHEREAS on March 25, 2021, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of By-law No. 1 in respect of a disciplinary proceeding commenced against Christine Claudette Levesque (the “Respondent”);

AND WHEREAS on May 25, 2021, the first appearance in this proceeding was held before one public representative of a Regional Council acting as Chair on behalf of a hearing panel of the Central Regional Council of the MFDA (the “Hearing Panel”), pursuant to s. 19.13 of MFDA By-Law No. 1, and the hearing on the merits was scheduled for December 7-8, 2021;

AND WHEREAS on August 19, 2021, the hearing on the merits was rescheduled for January 26-27, 2022;

AND WHEREAS on January 24, 2022, the Respondent sent an email to the MFDA Corporate Secretary’s Office requesting an adjournment of the hearing on the merits so she could retain counsel;

AND WHEREAS on January 25, 2022, an interim appearance in this proceeding was held before the Hearing Panel, and on hearing the submissions of the Respondent and MFDA Staff the Hearing Panel held that if by the commencement of the hearing on the merits in this proceeding on January 26, 2022, the Respondent provided evidence to MFDA Staff that she had retained legal counsel by way of a confirmation email or telephone call, then the hearing on the merits in this proceeding would be adjourned for a reasonable period of time. In the event that the Respondent failed to provide such confirmation at the commencement of the hearing on the merits in this proceeding, the hearing on the merits would commence as scheduled on January 26, 2022; and

AND WHEREAS at the commencement of the hearing on the merits, counsel appeared to advise the Hearing Panel that she had not been retained by the Respondent to represent her at the hearing on the merits and that counsel required time to meet with the Respondent in order to assess whether she could represent the Respondent in this proceeding;

IT IS HEREBY ORDERED THAT:

  1. A further interim appearance shall take place by teleconference on February 3, 2022 at 12:30 p.m. (Eastern), or as soon thereafter as the appearance can be held.
