Order

WHEREAS on January 18, 2016, the Mutual Fund Dealers Association of Canada (the “MFDA”) issued a Notice of Hearing pursuant to sections 20 and 24 of MFDA By-law No. 1 in respect of a disciplinary proceeding commenced against Mervin Evans Visneskie (the “Respondent”);

AND WHEREAS the Respondent filed a Reply on March 31, 2016;

AND WHEREAS a first appearance took place on May 9, 2016 via teleconference before one public representative of a Regional Council acting on behalf of a Hearing Panel of the Central Regional Council of the MFDA (the “Hearing Panel”), pursuant to section 19.13(b) of MFDA By-law No. 1, resulting in an Order dated May 9, 2016;

AND WHEREAS a second appearance took place on November 21, 2016 via teleconference before one public representative of the Hearing Panel, resulting in an Order dated November 21, 2016;

AND WHEREAS a third appearance took place on March 6, 2017 via teleconference before one public representative of the Hearing Panel, resulting in an Order dated March 6, 2017;

AND WHEREAS a fourth appearance took place on July 11, 2017 via teleconference before one public representative of the Hearing Panel;

AND UPON hearing the submissions of counsel for the Respondent and counsel for Staff of the MFDA at the fourth appearance with respect to the Respondent’s request for an adjournment and various procedural matters;

IT IS HEREBY ORDERED THAT:

1. The Hearing on the Merits as previously scheduled is adjourned, and is scheduled to proceed before the Hearing Panel in the MFDA hearing room located at 121 King Street West, Suite 1000, Toronto, Ontario on October 30 to November 3, 2017 at 10:00 a.m. (Eastern) each day, or as soon thereafter as possible.
