The MFDA has implemented a process to allow Members to obtain information about the enforcement history of their Approved Persons and prospective Approved Persons with the consent of the Approved Person.
The MFDA enforcement activity information that will be provided is limited to the following:
- A list of all files closed with formal or informal disciplinary action, and copies of any Warning Letters, Cautionary Letters, Agreements and Undertakings, Settlement Agreements and MFDA Hearing Panel Decisions;
- A list of all open files, and copies of Opening and Escalation Letters; and
- The number of event reports filed on METS regarding the Approved Person.
The fee for this information is $50 per history requested.
To make a request, the Member must obtain the completed Consent to Release of MFDA Enforcement Activity History and Release from Liability from the Approved Person, sign and complete the Member portion, and submit it, along with the applicable fee, to the MFDA. A copy of this form is available on the Policy and Regulation section of the MFDA website and the Members’ Only section of the MFDA website.
The information will be sent electronically to the requesting Member’s Chief Compliance Officer and to the Approved Person at the email addresses provided with the request. This process is also available to current and former Approved Persons directly.

This form is used for requesting information related to enforcement history with the Mutual Fund Dealers Association of Canada (“MFDA”).
